COMPETITION LAW



BMH, public and private company counsel, is consulted regarding executions of partnership agreements, use of exclusive rights awarded to a company by public authorities (concession, intellectual property), awarding of government subsidies likely to interfere with fair competition (subsidies procedure), or discriminatory or monopolistic practices (cartels, abuse of dominant position).

BMH
prepares a market analysis of its client's position as well as that of the different operating bodies

defines the strategy and quantifies the risks in relation to litigation or chosen defence tactics

fosters awareness of control authorities on the anti-competitive practice observed by its clients

notifies the competent bodies (DGCCRF, French competition authority, European Commission)

assists its clients before French and European Community jurisdictions handling case brought upon them

advises the company on defining its new market positioning.


BMH contributes to defining tariff and commercial policies, general terms of sale and purchase, when implementation of distribution networks (exclusive or selective distribution), and finalizes agreements of commercial cooperation.
