ENERGY

BMH accompanies firms through implementation of full competition in the electricity markets and the development of renewable energy.

Aware of the major orientations in French and European community energy policy, BMH advises companies on the establishment of electricity manufacturing units (wind generators or co-generation) on French territory and on their intervention on electricity commodity market.

BMH apprehends the legal problematics related to the production and commercialization of renewable energy, on both a global and specific scale.

On this type of cases, BMH provides its clients with advice on public and private law, on financing and project management (corporate law, fiscal law), the creation and organization of operating companies, competitive bidding and the issuance of administrative authorizations, the drawing up and awarding of contracts, real-estate development, the transportation and marketing of electricity on the national, European, and international markets.

BMH participates in contract negotiations with national operators (Electricité de France, Réseau de transport de l'électricité, etc.) and takes care of relationships with local governments, ministries, administrations (ADEME — Agency for the Environment and Energy Management, DDE — Departmental Facilities Directorate, DRIRE — Regional industry, research and environmental authority), and the Commission de régulation de l'électricité (CRE).

BMH represents companies in litigation related to the co-generation of electricity (product liability).

On 4th November 2005 BMH has organised a conference on "The new French law on energy policies (the "POPE law") : impact on renewable energies and investment prospects".

BMH is a member of AEEC.
