BMH/Compétences juridiques

AGRICULTURE AND FOOD INDUSTRY

On the strength of its experience in European Community law and well aware of the variety of legal profiles and issues faced by the different providers in the food chain (producers, processors, packaging manufacturers, distributors, and consumers), BMH delivers a legal service targeted at guaranteeing full consumer awareness (product regulation, labelling, etc.), free movement of food products within the European Union, and compliance to rules of competition (cartels, government subsidies, parafiscal taxes).

Acting at times on behalf of agriculture and food industry and pytosanitary industry representatives and at others for French and foreign federations of agriculture or for distribution and manufacturing companies, BMH advises operators of the sector on a national and European Community wide advocacy basis (European Commission and jurisdictions) and fosters their awareness regarding compliance to the principles of food safety concerning food products for consumers (DGCCRF).

BMH accompanies international brokers in commodity products (oilseed, cereal crops) in the disputes that oppose them, before the London (GAFTA) and Paris arbitration courts, or within the export of goods (export subsidies "refunds").

BMH assists distributors and manufacturers in penal, commercial, and/or European law litigation, with regard to consumer law (Law of 1905 on products loyalty).

BMH also intervenes on behalf of their clients throughout investigations and controls carried out by the French governmental entity for competition and fraud (DGCCRF).
